Terms of Service

These Terms of Service ("Terms") govern your access to and use of GitPort ("Service"), operated by Danique Wijnalda, an individual established in the Netherlands ("we", "us", or "our"). By using the Service, you agree to be bound by these Terms.

1. Description of Service

GitPort is a unified Git dashboard that connects to third-party Git providers (such as GitHub and GitLab) via their public APIs. The Service allows you to view, manage, and act on repositories, pull requests, issues, and notifications from all connected accounts in one place.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this requirement and are able to enter into a binding agreement. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Accounts

You may sign up using OAuth authentication provided by a supported Git provider, or with an email address and password. You are responsible for maintaining the security of your account credentials. You must notify us immediately via our support centre if you suspect any unauthorised use of your account.

4. Connected Providers

When you connect a Git provider account, you authorise GitPort to access that account's data and perform actions on your behalf, within the permissions you grant during the OAuth flow. You can disconnect any provider at any time from your account settings. GitPort is not affiliated with, endorsed by, or sponsored by GitHub, GitLab, or any other third-party provider.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations;
• Access or attempt to access accounts or data you are not authorised to access;
• Interfere with or disrupt the integrity or performance of the Service;
• Attempt to reverse-engineer or circumvent any security measures.

Additional rules governing your use of connected Git provider accounts and API access are set out in our Acceptable Use Policy, which is incorporated into these Terms by reference.

6. Subscriptions and Payments

GitPort does not currently offer paid plans. This section will apply once paid subscriptions become available.

7. Intellectual Property

The Service, including its design, code, and content, is owned by Danique Wijnalda and protected by applicable intellectual property laws. Your use of the Service does not grant you any ownership rights. Any content you access via connected Git providers remains subject to the terms of those providers.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by applicable law. We do not guarantee that the Service will be uninterrupted, error-free, or that data retrieved from third-party providers will be accurate or complete.

Nothing in these Terms excludes or limits any warranty that cannot lawfully be excluded or limited. If you are a consumer, the above disclaimer does not affect your non-waivable statutory rights.

Nothing in this section limits or excludes any rights you have as a consumer under mandatory Dutch or EU consumer law, which cannot be waived by contract.

10. Limitation of Liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.

Subject to the above, and to the fullest extent permitted by law: (a) we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill; and (b) our total aggregate liability arising out of or in connection with the Service is limited to the greater of (i) the total fees you paid us in the 12 months before the event giving rise to the claim, or (ii) EUR 50.

If you use the Service as a consumer, this limitation does not affect your mandatory statutory rights, and we remain liable for damage caused by our breach to the extent required by law.

11. Your Responsibility for Connected Accounts

When you perform actions on connected provider accounts through GitPort — for example, merging or closing a pull request, or editing an issue — GitPort acts on your instructions. You are responsible for those actions and for ensuring you are authorised to take them. To the extent permitted by law, you agree to be responsible for losses we incur as a result of your misuse of the Service or your breach of these Terms or our Acceptable Use Policy. This does not apply to losses caused by our own breach or negligence and does not affect your statutory rights as a consumer.

12. Termination and Suspension

You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate your access, or disconnect a connected provider, where you materially breach these Terms or our Acceptable Use Policy, where required by law, or where continuing to provide the Service is no longer reasonably viable. Except where prohibited or impractical — for example, on security grounds — we will give you notice. On termination, your right to use the Service ends and your data is deleted in accordance with our Privacy Policy. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes — for example, by email or an in-app notice — before they take effect, and where a change materially affects a paid subscription we will give you reasonable advance notice. For non-material changes, we will update the "Last updated" date. Your continued use of the Service after a change takes effect constitutes acceptance, except where your explicit consent is required by law.

14. General

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in effect. We may transfer our rights and obligations under these Terms to another organisation — for example, if the Service is acquired — without affecting your rights. We are not liable for any failure or delay in performance caused by events beyond our reasonable control. These Terms, together with the Acceptable Use Policy and Privacy Policy, form the entire agreement between you and us regarding the Service.

15. Governing Law

These Terms are governed by the laws of the Netherlands. If you are a consumer, you also benefit from any mandatory provisions of the law of the country where you live, and nothing in these Terms affects your right to bring proceedings in the courts of your country of residence. Disputes not subject to such consumer protections are subject to the jurisdiction of the competent Dutch courts.
